  3.                       BMP2RLE License Agreement
  4. ==========================================================================

  6. Your use of BMP2RLE indicates your acceptance of the following
  7. terms and conditions:

  9. BMP2RLE ("the Software") is a Windows application
  10. licensed by trailBlazers Software ("TBS").
  11.  
  12. Shareware license.
  13. You are free to distribute the entire unmodified contents of the distribution
  14. package to anyone you wish. For a period of no more than 15 days, you may use, test
  15. and duplicate the enclosed version of the Software.  Thereafter if you wish
  16. to continue using the Software you must register the Software with TBS, or
  17. else you must cease all use of the Software.  You will be an infringer if
  18. you do not pay the registration fee and continue to use this version of the
  19. Software for more than 15 days.

  21. Registered User License.
  22. If you pay the registration fee for the Software to TBS, TBS will grant a
  23. non-exclusive license for one natural person to use one copy of the software
  24. regardless if the owner of the license is a person or a business
  25. ("the Licensee").  No purported transfer of the license shall be effective 
  26. until the licensee notifies TBS of the
  27. name and address of the person receiving the license ("the Transferee"), and
  28. transfers all copies of the Software to the Transferee, and removes or
  29. destroys any other copies of the Software in the possession of, or under the
  30. control of the Licensee.

  32. Disclaimer and Limitation of Warranty.
  33. The Software is distributed and licensed under an "as is" basis. TBS makes no 
  34. claims as to the suitability of the software for any specific
  35. purpose. EXCEPT FOR THE LIMITED WARRANTY STATED ABOVE, TBS DISCLAIMS ANY AND
  36. ALL OTHER WARRANTIES EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING ANY
  37. WARRANTIES OF MERCHANT ABILITY OR FITNESS FOR ANY SPECIFIC PURPOSE. The
  38. Limited Warranty stated above gives you specific legal rights, but you may
  39. have other rights which may vary from state to state.

  41. Limitation of Liability.
  42. In no event shall TBS be liable for any damages whatsoever arising out of
  43. the use of the Software, including without limitation any direct, indirect
  44. or consequential damages or any damages for business interruption, loss of
  45. profits, loss of information, or any pecuniary  loss even if TBS has been
  46. notified of the possibility of such damages. The limitation or exclusion
  47. of liability for incidental or consequential damages may not be allowed in
  48. some states, and in these states those particular prohibited limitations do
  49. not apply.

  51. Limitation of Remedies.
  52. Should you have problems with the Software, TBS's entire liability and your
  53. exclusive remedy shall be, at TBS's discretion, either (a) to repair or
  54. replace the Software, or (b) to terminate the License and send you a refund
  55. of your registration fee minus a restocking charge, provided that all
  56. materials are returned undamaged. If the materials are damaged your refund
  57. will be deducted for the replacement costs of the damaged materials.

  62. The Software is protected by the copyright laws of the United States, and
  63. by the copyright laws of many other countries pursuant to international
  64. treaties. The Software and all other materials provided in the accompanying
  65. distribution package are Copyright (c)1994 trailBlazers Software.  All Rights 
  66. reserved.  No portion of the Software, documentation or examples may be copied, 
  67. stored, or transmitted except as provided by the license.
